IMPORTANT: two entirely unrelated companies share this name - a Lithuanian sportsbook/casino operator with a documented self-exclusion enforcement failure, and a wholly Australian-owned corporate bookmaker
Visit TopSport →Online casino is not lawful in Australia
We show no casino offer here on purpose. Under the Interactive Gambling Act 2001, supplying online casino games to someone in Australia is prohibited - so a casino bonus aimed at you here comes from an operator working against that law, whatever licence it holds elsewhere.
Providing online casino games - pokies, roulette, blackjack, online poker - to someone in Australia is prohibited under the Interactive Gambling Act 2001. Licensed SPORTS BETTING is a different matter and remains lawful, which is why this market still shows bookmaker offers: almost every Australian online bookmaker is licensed by the Northern Territory Racing and Wagering Commission, and the same Act separately bans online IN-PLAY betting. The two casino offers we previously published here were, by our own recorded conditions, offshore operators with no Australian licence.
Pros
- Both entities hold genuine local licences (Lithuania no. 0046; Australia NSW)
- Australian TopSport is a long-established (30+ years), wholly Australian-owned corporate bookmaker with no similar findings
Cons
- Two unrelated companies share this exact name - genuine risk of reader confusion
- Lithuanian entity: EUR 25,000 fine (court-upheld) for a self-excluded player gambling unimpeded for 23 days
- Lithuanian entity: separate advertising-related fine also issued
- No welcome bonus legally available in either market
Our verdict
We want to flag an important name-confusion finding directly: our source data lists 'TopSport' for both Lithuania and Australia, but these are TWO ENTIRELY UNRELATED COMPANIES that happen to share the same generic name. In Lithuania, UAB Top Sport (licence 0046 from the Losimu Prieziuros Tarnyba, established 2001 in Kaunas) offers sportsbook and casino products, but has a serious, specific, court-upheld regulatory finding: the Gaming Supervision Authority fined it EUR 25,000 after an unscheduled inspection found that a self-excluded person was able to access and intensively gamble, bet, and make payments on the platform for 23 days - the company's appeal was rejected by both the Regional Administrative Court and, on further appeal, upheld as legitimate. A separate advertising-related fine was also issued against this entity. In Australia, TopSport is the trading name of Merlehan Bookmaking Pty Ltd, a wholly Australian-owned corporate bookmaker founded by the Merlehan family with over three decades in the bookmaking industry, licensed in New South Wales - a genuinely different, unrelated business with no similar findings that we found. Neither entity offers a welcome bonus, since Lithuania bans all gambling promotions since 1 July 2021 and Australian states prohibit new-account inducement advertising. We report both distinctly given the real risk of readers confusing them.
How we rated it
Sportsbook & Casino (36%)5.5
The Lithuanian entity (UAB Top Sport) offers sportsbook and casino products under a licensed local framework; the Australian entity is a long-established, wholly Australian-owned corporate bookmaker.
Customer support (18%)5
Not exhaustively documented independently for either entity beyond the regulatory findings noted above.
Bonuses & value (18%)3
No welcome bonus is legally available in either market: Lithuania bans all gambling promotions since 1 July 2021, and Australian states prohibit new-account inducement advertising.
Trust & licensing (27%)3
Both entities are genuinely licensed (Lithuania licence 0046; Australia NSW licensing per the operator's own disclosure). However, the Lithuanian entity has a serious, specific, court-upheld enforcement finding: a self-excluded player was able to access and intensively gamble on the platform for 23 days, plus a separate advertising-related fine - we score conservatively for this.
Quick facts
| LITHUANIA - Owner | UAB Top Sport (2 shareholders, names not publicly disclosed) |
| LITHUANIA - Licence | No. 0046, Losimu Prieziuros Tarnyba; established 2001 |
| LITHUANIA - SERIOUS FINDING | EUR 25,000 fine (upheld on appeal) - self-excluded player gambled unimpeded for 23 days; separate advertising fine also issued |
| AUSTRALIA - Owner | Merlehan family, via Merlehan Bookmaking Pty Ltd |
| AUSTRALIA - Licence | New South Wales (per operator's own disclosure; one secondary source inconsistently cites Northern Territory) |
| Welcome bonus | None legally available in either market (Lithuania promotions ban 2021; Australian inducement-ad bans) |
How we verified this
The Lithuanian entity's licence number (0046), 2001 establishment, and the EUR 25,000 fine over the self-exclusion enforcement failure (a self-excluded player gambling for 23 days, upheld by the Regional Administrative Court and Supreme Court on appeal) are corroborated across Lithuania's own gambling regulator (Losimu Prieziuros Tarnyba) and independent Lithuanian press (LRT). The Australian entity's ownership (Merlehan family, Merlehan Bookmaking Pty Ltd) and NSW licensing are drawn from the operator's own official 'About' page; one independent secondary source cites Northern Territory licensing inconsistently with the operator's own disclosure, which we note as a discrepancy. Lithuania's full gambling-promotions ban (effective 1 Jul 2021) and Australian state-level inducement-advertising bans are corroborated by independent industry press (iGaming Business) and state regulatory sources (WA DLGSC) respectively.
